Reservations for short-term holiday accommodation are accepted by Serenity Holiday Properties (SHP) ABN 15 822 573 409 of PO Box 47 Yallingup, WA 6282 (“the Booking Agent”) as agent for the Owner of the Property and to which bookings the following terms and conditions shall apply:

Right to Refuse or Revoke Bookings – No School Leavers

The Booking Agent and the Owner reserve the right to revoke or refuse to honour any property accommodation booking which may in the opinion of either party (at their sole discretion) be unsuitable for the Property concerned. School Leavers bookings are not accepted, no exceptions. The property owner reserves the right to refuse entry to anyone, who in the property owner’s opinion is not suitable to or capable of taking charge of the property.

Rental Contract

The rental contact is between the Guest and the Owner of the Property for which the accommodation booking is made and is subject to the terms and conditions herein. The contract for accommodation shall not be effective until SHP sends the Guest written confirmation of the booking. The Guest acknowledges that the Booking Agent acts as a booking agent for the Owner only and not as a principal. By entering into the rental contract the Guest accepts that SHP Cancellation Terms override any Terms stipulated at the time of reservation by any booking platform including online Travel Agents.

THE GUEST

The guest who enters into the rental contract accepts responsibility for the care and safety of all persons, property and equipment at the short-term holiday accommodation during the stay, including their guests, visitors and any minors on the property in their custody, care or control. Guests agree not to leave minors unsupervised or alone at the property at any time.

Deposit

The accommodation rental contract (booking) will not be confirmed by the Booking Agent until the Guest’s deposit payment (50% of the total accommodation tariff) is received and cleared. If the accommodation booking is made within two (2) weeks of the date of commencement of the Guest’s proposed holiday, the full tariff payable for the Property is required together with any bond, credit card information and any other payment applicable.

Booking Confirmation

Once a Guest’s booking has been confirmed, the Guest shall be responsible for payment of the total tariff for the rental period, the Guest Security Bond and any extras shown on the confirmation notice, on or before the date or dates referred to in such notice. 

Final Payment

The full amount payable in respect of the Property rental & Guest Security Bond shall be paid at least two (2) weeks prior to the date of commencement of the booking. If the full payment has not been received by the Booking Agent at least fourteen (14) days prior to the start of the rental period, then the Booking Agent and the Owner reserve the right to cancel the booking without notice and the Guest will forfeit the Guest’s deposit which will be non-refundable in such circumstances.

Changes to Holiday Bookings

Where possible, SHP will accept certain changes to a booking after a booking has been confirmed with a deposit. Changes such as moving from one property to another after the final payment has been made will only be possible under exceptional circumstances. In such cases an administration fee of $50.00 may be charged.

Cancellation

The Guest accepts that SHP Cancellation Terms override any Terms stipulated by any booking platform including online Travel Agents at the time of making the reservation. When cancellation in writing is received up to, but not including 14 days before the arrival date, the deposit will be refunded, less a $100 administration fee. From 14 days, the deposit is non-refundable, UNLESS Serenity Holiday Properties can RE-BOOK THE PROPERTY FOR THE SAME PERIOD THE DEPOSIT COVERED, AT THE SAME NET RATE. If a new booking is confirmed for this period, a discretionary refund of the deposit may be made, less a $100 administration fee. If the dates reserved by your booking are not on-sold the deposit is forfeited.

We recommend that the Guest takes out comprehensive holiday cancellation and protection insurance to cater for any unforeseen circumstances which may arise including accident, illness, or any other matters beyond the Guest’s reasonable control. Should an event arise beyond the reasonable control of SHP, resulting in the property being uninhabitable e.g., flood, fire, storm etc., or the property is sold by the owner the booking may have to be cancelled. The Guest accepts that SHP may relocate the guest to a similar holiday home or transfer the booking and deposit to a suitable future date, within a six-month period. If this is not possible, a full refund of any payment made by the guest will be given. No further compensation will be offered or paid.

CANCELLATION / SELF QUARANTINE DUE TO INFECTIOUS DISEASE

Properties managed by SHP are unable to provide accommodation for those undergoing self-quarantine. If you are required to self-quarantine for any reason you must complete this period of self-quarantining before commencing your stay with us. As a condition of entry to Properties, Guests must be able to provide evidence that any previous self-quarantine requirements have been met.

If a Guest, or any close contacts, develops symptoms of any infectious disease, including COVID19, in the 14 days prior to their stay / in transit / during their stay: the Guest should immediately attend the nearest medical clinic for testing and instruction, and immediately advise SHP by phone call 0400 912 314. The Guest will obtain from the medical clinic and provide to SHP a medical certificate. If the medical certificate indicates an infectious disease or a requirement to self-quarantine, the Guest stay will be cancelled and 50% of any monies paid by the Guest for unused nights will be fully transferrable to new dates of stay at the Property; and the new stay must occur within 6 months and be booked outside of school holidays, Easter, peak and special events periods and long weekends. If the Guest has commenced their stay, the Property will need to immediately be vacated by all persons, and those persons should follow medical advice to return home / to alternate accommodation suitable for self-quarantine. External contractors will be engaged to deep clean and sanitise the Property and any related costs will be charged against the Guest Bond.

Guest NUMBERS, BEDS, LINEN & EVENTS

Extra adult/child guests $45 per person per night, plus $200 bond; ONLY WITH PRIOR WRITTEN PERMISSION of SHP. Under no circumstances may the number of persons staying at the property exceed those indicated on the SHP Booking Confirmation, nor the local council regulations. Exceeding guest numbers booked will forfeit the Bond in its’ entirety.

Linen will only be provided for the number of adults and children booked. Guests may bring port-a-cots for babies and infants under 2 years; however, linen is not provided. Babies, infants sleeing in own cots stay free of charge.

Guests are not permitted to bring extra beds to the property for adults or children, including swags, sleeping mats or inflatable mattresses. Guests may not bring tents, caravans, or campers to the Property.

Local Council regulations allow holiday homes to be rented for accommodation purposes only, with a maximum number of guests allowed to occupy, and not as a function venue e.g., for a wedding or party. Functions and gatherings are not permitted and, if evidenced, may be closed immediately and result in the security bond being forfeited in full. Owner/Agent reserves the right to evict guests contravening Booking Terms & Conditions and to reclaim damages against the Bond.

Guest Accommodation Security Bond

A $500 Security Bond is required per Property for up to a maximum of 4 guests and an additional $200 per guest thereafter, which will be refunded within 7 days of departing the property, provided there is no loss or damage to the Agent or Owner.

Pet accommodation & Bond

There is an additional Accommodation Charge of $50 per night per pet & a Pet Bond of $500 is required. Pets are only permitted at pet-friendly listed properties and with the prior consent of Serenity Holiday Properties and the property Owners. Guests who bring pets to properties without written permission of the Owner / Agent will be immediately evicted and forfeit any rental monies and bonds paid in full. Any specific terms for pets must be adhered to. Where pets are permitted, they are always to be kept under control. The Guest is responsible for any damage caused by pets whether inside or outside the property. If extra cleaning is required because of a Guest having pets in the property, this may be deducted from the Security Bond. Pets are not permitted into bedrooms or on the furniture at any time. Neither Serenity Holiday Properties nor property Owners can accept responsibility for pet safety. Guests agree not to leave pets unsupervised or alone at the property at any time. Pets should be cleaned and fully dried off before being allowed to enter the property after being outside. Guests agree to bring their own pet bedding, food bowls and other pet items to the property. Guests must dispose of pet faeces and this is to be done in a clean and sanitary manner. Serenity Holiday Properties or the Owners cannot guarantee that pets have not been kept previously at the property. Additional pet restrictions may apply at some properties and these will be detailed in any Property Specific Terms and Conditions. Guests should ensure that any arrangements in place for pets at a property, including these terms, are suitable for their pet prior to booking.

Water Bodies: Swimming Pools, Spas, Hot Tubs, Dams, Soaks, Ponds, Natural & Other Water Bodies On or In Close Proximity to the Property

By accepting entry to the Property, the Guest acknowledges to have read, understood and agreed to the Serenity Holiday Properties – Guest Use of Water Bodies & Equipment – Release of Liability, Waiver of Claims and Assumption of Risk document, which explains inherent risks and hazards of water bodies to themselves, their guests & all minors in their care, custody or control. At no time is there a lifeguard on duty and water bodies may not be fenced. Guests to the Property are responsible for access to and the safe operation of the pool, or spa, or hot tub and any equipment, including but not limited to operational and rescue equipment; and are responsible for all persons using these water bodies during their stay, including first aid. Neither the Booking Agent nor the Owner shall accept any responsibility for any injury, loss or damage to property or any third party arising from the use thereof. Under no circumstances may guests erect inflatable /transportable pools or spas on the property.

the property includes any Additional Amenities & Equipment

If additional equipment such as pools, spas, vehicles, boats, boards or amenities, such as saunas or courts are indicated as being available at the Property concerned, the additional charges to the Guest (if any) will be paid at the time of use, unless otherwise stated in the confirmation. By accepting entry to the Property, the Guest acknowledges and accepts full responsibility for the supervision and use of any additional amenities & equipment on behalf of themselves, their guests & all minors in their care, custody or control. The Guest will only allow use by those persons suitably licensed and qualified to operate. Neither the Booking Agent nor the Owner shall accept any responsibility for any injury, loss or damage to property or any third party arising from the use thereof.

Noise & Neighbours

SHP want you to enjoy your stay, however, please be aware of the impact of your noise on others and that keeping our neighbours happy is of paramount importance. Noise and music should not impact any other property and noise levels are always to be respectful. There is to be no outdoor music or outdoor entertaining after 10pm. Please be aware that noise complaints indicate you have breached the Booking terms and conditions and will result in the forfeit of your bond and could lead to the immediate termination of your stay and loss of any rental monies paid. This property is not intended for parties, functions or events and under no circumstances may the number of persons on the property exceed the number of guests booked.

Strata Properties

Guest must follow the instructions of Strata Managers and adhere to the bylaws and rules of the strata complex that the Property is located within, including use of common areas, access, noise, curfews, parking in designated parking bays only and disposing of rubbish responsibly in the allocated areas.

Guest’s Obligations in Respect of the PROPERTY

The Guest shall be responsible for the Owner’s Property during the Guest’s stay. The guest shall not allow any unlawful or improper use of the Property. The Guest shall keep the Property secure from theft or unlawful entry. The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property in its original condition, including all utensils, fixtures, fittings, and equipment on, in or about the Property put back away in their original location and in a clean and tidy condition. Furniture/furnishings must not be moved about the property and on departure must be left in their original location. This includes the return and replacement of any lost or damaged items, including but not limited to movies, boardgames, books and equipment supplied by the Owner for Guest use. The Guest shall be liable for any extra cleaning, breakages or damage caused to the Property or any part thereof, or any of the chattels therein, that may occur during the Guest’s occupation of the Property. All costs for extra cleaning time / cleaning surcharges for hazardous or unsanitary conditions, maintenance, repairs, replacements, relocation of furniture or equipment and administration thereof, shall be payable to the Booking agent or the Owner from the Guest Security Bond. Any such costs over and above the amount taken as a Guest Bond may be sought by the Owner through the Local Court. Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the Local Agent, Booking Agent or Owner as soon as practicable after the damage occurring thereto.

Guest’s Property

All personal belongings, baggage, vehicles and other property of the Guest of any description shall always be the risk of the Guest and neither the Booking Agent nor the Owner accepts any responsibility for any loss or damage thereto.

Representations

The Guest acknowledges that the Booking Agent has used its best endeavours to describe the Property to the Guest within the limited extent of the communications between the Guest and the Booking Agent and the Booking Agent shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever.

Description of the Property

All information in respect of the Property contained in the Booking Agent’s website is believed to be correct at the time of the publication, however all details are subject to change by the Booking Agent and/the Owner without notice. The Booking Agent will not accept any responsibility for any alterations to the Property or any part thereof beyond the Booking Agent’s control or any liability for any matter or occurrences beyond the Booking Agents reasonable control, including damage caused by extreme weather conditions, breakdown of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.

Availability of Property

The short-term accommodation contract negotiated by the Booking Agent and made between the Guest and the Owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest. Should any events whatsoever arise beyond the reasonable control of the Booking Agent which render the Property uninhabitable (for example flood, fire, storm, tempest, etc) or the property becomes for sale or is sold by the Owner, then the Booking Agent may have to cancel the Guest’s booking for the Property. Should such circumstances arise then the Booking Agent will endeavour to relocate the Guest to a holiday home of similar standard to the property in the same area. Where this is not possible, the Booking Agent will refund all monies paid by the Guest in respect of the Property, for unused nights. Upon refund of the monies paid, the guest shall have no further claims whatsoever against the Owner of the Property or the Booking Agent.

Owner / Agent Right to Enter Property / Right to Inspect

The Owner /Agent reserves the right to enter the property in the event of an emergency, or remedial repair work being required and will endeavour to carry out non-urgent repairs at a reasonable time. If the Owner or Agent is made aware that occupation of the property has become unsafe, or that the Guest has breached the terms of this agreement, the property Owner /Agent is entitled to inspect the Property immediately and to ask the holidaymaker to leave the property without any refund, including if, in the property Owner’s /Agent’s opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.

Vacation Rental Liability Waiver

By booking and accepting entry to the Property, the Guest assumes all risk, and takes full responsibility and waives any claims of personal injury, death or damage to personal property associated with activities and events during or related to the stay in the subject property, for themselves, their guests & all minors in their care, custody, or control. Further the Guest releases from liability and waives all claims they may have or may have in the future against Serenity Holiday Properties and its members, principals, agents, officers, employees, and representatives (collectively “Releasees”) as well as the landlord/owner of the Property.

Updates to the Terms & Conditions

The Terms & Conditions of Booking are updated from time to time as is necessitated and to retain consistency across booking platforms. When the Terms and Conditions are updated, we will notify you by any of the following methods: by contacting you directly, including SMS or email, or via the Serenity Website. If you feel an update is unfair, you can cancel your reservation without penalty, if you contact us no less than 14 days after the date of notice and not less than 14 days prior to arrival.

BY BOOKING AND ACCEPTING ENTRY TO THE PROPERTY, THE GUEST ACKNOWLEDGES THAT THEY HAVE READ THIS ENTIRE DOCUMENT AND HAVE UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. THE GUEST UNDERSTANDS THAT THE EFFECT OF THIS DOCUMENT IS THEY ARE RELEASING LIABILITY AND WAIVING THEIR RIGHT TO SUE RELEASEES AND THE GUEST IS ASSUMING RISK FOR MATTERS RESULTING FROM, ARISING OUT OF OR RELATING IN ANY WAY TO THE RENTAL AND STAY AT THE PROPERTY, INCLUDING BUT NOT LIMITED TO LOSS OF USE, EVICTION, LOSS OF BOND, PERSONAL INJURY, DEATH AND PROPERTY DAMAGE. THE GUEST ACKNOWLEDGES THAT THIS DOCUMENT APPLIES EVEN IF RELEASEES MAY BE NEGLIGENT IN WHOLE OR PART. THE GUEST UNDERSTANDS THAT THIS DOCUMENT APPLIES TO AND SHALL BE EFFECTIVE AND BINDING UPON THEMSELVES, THEIR HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, ESTATE, AND ALL MEMBERS OF THEIR FAMILY, MINORS, AND OTHERS IN THEIR CARE, CUSTODY OR CONTROL.
